Steve Duggan, Esq

Biography

Steve has practiced as a criminal and civil trial lawyer for the last 10 years in State and Federal court representing clients in criminal cases, civil and commercial litigation, municipal and employment cases, and divorce/family cases. He has tried cases before juries and judges with successful outcomes for his clients and settled hundreds of cases short of trial with favorable results.

Steve’s philosophy is to provide clients with timely, assertive, and cost effective counsel and legal representation. In litigated matters, Steve’s goal is always to work towards a favorable settlement, if possible, while preparing a vigorous defense for trial if required.

Steve has recently expanded his practice to include increased representation of clients going through a divorce and family law issues. He continues to pursue an interest in alternative dispute resolution by mediating cases as a volunteer mediator in Merrimack and Hillsborough counties, and is expanding this practice to include private mediation.

Representative Cases:

  • Retail flooring product outlet client was sued in Superior Court for alleged negligent misrepresentation and violation of the New Hampshire Consumer Protection Act with respect to the sale of wood flooring product. The plaintiff claimed that the client misrepresented the color and quality of the wood flooring that was purchased. The plaintiff did not inspect the product before installing the floor in his house, and later claimed the color was off and the product was sub par. He alleged he was entitled to triple damages under the Consumer Protection Act. A jury trial was held with the plaintiff, client and several other witnesses providing testimony concerning the sale and quality of the wood flooring that was sold. The jury was shown photos of the floor and samples of the wood product, along with the paperwork concerning the sale of the flooring. After two days of evidence, the case was submitted to the jury who deliberated for twenty minutes and returned a DEFENDANT'S VERDICT.
  • Client was sued in Superior Court for alleged negligence in an automobile accident. Client's vehicle was the second in a three-car accident. The plaintiff was the first vehicle in line and claimed he was stopped at a red light and was hit from behind by client. Plaintiff sued both the client and the driver of the third car. Client stated that plaintiff stopped short at the red light, that the car behind her was speeding and did not see that client had slowed to stop, and slammed into client, pushing her into the plaintiff. Depositions were taken where evidence obtained showed the woman in the third vehicle was on her cell phone and in a hurry to get to work. The testimony also tended to show that the plaintiff was not stopped at the red light before the accident, but did indeed stop short. That the client was traveling within the speed limit and did nothing wrong. The plaintiff and both defendants testified at trial and were cross-examined. They both dwindled; plaintiff admitted he was not at a complete stop; co-defendant admitted she might have been speeding. The case was submitted to the jury and after 30 minutes of deliberation, the jury came back with a DEFENDANT'S VERDICT.
